The shooting death of a cinematographer by actor Alec Baldwin on the set of “Rust” last year was an accident, New Mexico’s Office of Medical Investigator determined.

The medical investigator’s report, which was completed following an autopsy and a review of police reports, was made public Monday by the Santé Fe County Sheriff’s Office.

Prosecutors have yet to determine if any charges should be filed in the case as they review the latest reports, including from the FBI on the revolver and ammunition that were collected after the shooting.

They are also awaiting cellphone data from Baldwin’s legal team.

The medical investigator’s ruling led Baldwin’s lawyers to argue their client should not face charges connected to the “tragic accident” that killed Halyna Hutchins on Oct. 21. The film’s director, Joel Souza, was wounded in the shooting.

Baldwin told ABC News in December he pointed the gun at Hutchins after she instructed him to on the set of the Western film that Baldwin was also producing. He said the gun fired after he cocked it, but denied pulling the trigger.

“The trigger wasn’t pulled,” he said. “I didn’t pull the trigger.”

But an FBI analysis of the revolver Baldwin held suggested the gun worked and would not have gone off unless it was fully cocked and the trigger was pulled.

Nikas, Baldwin’s lawyer, told Fox News “the FBI report is being misconstrued.”

"Alec Baldwin will be criminally charged in connection with the “Rust” shooting that left cinematographer Halyna Hutchins dead, prosecutors said Thursday.

New Mexico prosecutors will charge Baldwin and armorer Hannah Gutierrez-Reed with two federal counts of involuntary manslaughter over the death of Hutchins on the “Rust” film set in October 2021, when a real bullet was loaded into a prop gun.

Assistant director David Halls, who handed Baldwin the loaded gun, accepted a misdemeanor charge in a plea deal.

“If any one of these three people — Alec Baldwin, Hannah Gutierrez-Reed or David Halls — had done their job, Halyna Hutchins would be alive today. It’s that simple,” special prosecutor Andrea Reeb said.

Baldwin and Gutierrez-Reed will both be charged “in the alternative,” meaning the jury will decide which of the two charges — involuntary manslaughter or involuntary manslaughter in the commission of a lawful act — they are or are not guilty of. Both felony charges hold a maximum prison sentence of 18 months and a fine of up to $5,000.

District Attorney Mary Carmack-Altwies, who will hand down the charges, said that following “a thorough review of the evidence and the laws … I have determined that there is sufficient evidence to file criminal charges against Alec Baldwin and other members of the ‘Rust’ film crew.”

What charges is Alec Baldwin facing?

Baldwin, 64, faces two counts of involuntary manslaughter for Hutchins’ October 2021 death on the set of the Western film.

The “30 Rock” star, who accidentally fired the fatal shot that killed Hutchins, was charged “in the alternative,” meaning if he’s found guilty, the jury will have to choose between two charges.

How much prison time could he get?

The first charge, involuntary manslaughter, is a fourth-degree felony that carries a maximum sentence of 18 months in prison.

The second charge, involuntary manslaughter in the commission of a lawful act, is also punishable with up to 18 months in prison — but prosecutors tacked on a firearm enhancement to the charge, which would mandate Baldwin spend five years behind bars.

Alec Baldwin was on the phone during firearms training for a movie where he fatally shot a cinematographer on set, prosecutors said, as they charged him with involuntary manslaughter.

Santa Fe's District Attorney's Office accused the actor of "many instances of extremely reckless acts".

Halyna Hutchins died on the set of Rust in New Mexico after Mr Baldwin allegedly fired a prop gun.

The film's armourer has also been charged with involuntary manslaughter.

The documents released on Tuesday detailing the charges - first announced on 19 January - portray a chaotic set with a reckless approach to gun safety.

Mr Baldwin was "distracted" talking to family members on his mobile phone during training on how to operate the prop gun, Robert Shilling, a special investigator for the district attorney's office, wrote in a statement of probable cause filed with the manslaughter charges.

If Mr Baldwin had performed mandatory safety checks with armourer Hannah Gutierrez-Reed and not pointed the gun at Hutchins, the "tragedy would not have occurred", Mr Shilling argued.

"This reckless deviation from known standards and practice and protocol directly caused the fatal shooting," he said.


"Baldwin knew the first rule of gun safety is never point a gun at someone you don't intend on shooting," Mr Shilling added.

The charging document outlines at least a dozen "acts or omissions of recklessness" leading up to the shooting, including:
  1. Not using a replica firearm for an unscheduled rehearsal

  2. Letting the armourer leave the set against protocol

  3. Deviating from the practice of only receiving the gun from the armourer

  4. Not dealing with safety complaints on set

  5. Not performing required safety checks with the armourer, who was hired without adequate certification

Lawyers for Mr Baldwin and Ms Gutierrez-Reed have said they intend to fight the charges in court.

If found guilty, Mr Baldwin and Ms Gutierrez-Reed could face up to 18 months in prison and a $5,000 (£4,050) fine. They will be tried by a jury, according to prosecutors.

Now, she is under fire again after she approached photographers in New York City to chew them out for taking pictures of her children.

Hilaria - who was born Hillary Lynn Hayward-Thomas - appeared to slip back into her old accent as she dodged questions about her husband's involuntary manslaughter charge.

The actor, 64, and armorer Hannah Gutierrez-Reed, were charged for the death of cinematographer Halyna Hutchins for firing the fatal shot on the set of Rust. Baldwin says he'll fight the charges vigorously, calling it a 'miscarriage of justice.'

His wife approached photographers this week, cutting off their questions, stating: 'I’m going to tell you what I’m going to say, you’re not going to ask me questions. I want you guys to realize we have seven kids, and you being here to escort them to school and to be there when they come home is not good.

Wearing a puffy winter coat and slicked-back hair, the embattled celeb was also seen stopping briefly at a Mexican food truck for lunch and looking downcast after popping into the upscale VRAI Jewelry store.

Hutchins’ family — including her younger sister, Svetlana Zemko — filed a Los Angeles suit against the star alleging battery and intentional infliction of emotional distress on the part of Baldwin, their lawyer Gloria Allred said at a press conference Thursday.

It has been revealed that the charges against Alec Baldwin and Rust set armorer Hannah Gutierrez-Reed for the fatal shooting death of cinematographer Halyna Hutchins were downgraded, dropping the potential five-year prison sentence for the pair.

The Santa Fe District Attorney’s Office formally downgraded the second of the two charges, which included a firearm enhancement, issued to Baldwin and Gutierrez-Reed on Friday, according to the Hollywood Reporter.

Both Baldwin and Gutierrez-Reed still face involuntary manslaughter charges, but the removal of the firearm enhancement on the second charge removes the possibility of a five-year prison sentence.

They still face up to 18 months in prison.

The actor, who was expected to be arraigned on Feb. 25, reportedly no longer needs to appear in court on Friday.

So far he has got off without any jail time.

Baldwin, 65, was charged with involuntary manslaughter over the Oct. 21, 2021 shooting of 42-year-old cinematographer Halyna Hutchins on the New Mexico set of the Western movie, after a prop pistol he was using for a scene unexpectedly fired a real bullet.

He pleaded not guilty to the charges, brought by the Santa Fe district attorney.

In a statement to The Post, Baldwin’s lawyers Luke Nikas and Alex Spiro said, “We are pleased with the decision to dismiss the case against Alec Baldwin and we encourage a proper investigation into the facts and circumstances of this tragic accident.”

“Rust” director Joel Souza was standing behind Hutchins viewing a camera angle as Baldwin rehearsed a scene in which he was to draw his revolver and point it at the camera when the tragic incident occurred.

He was also wounded in the shooting, with the bullet striking his shoulder.

“I owe everything I have to this woman,” he wrote in the caption, adding “(and to you, Luke),” referencing his lawyer Luke Nikas.

In her photo, Hilaria is nestled in her husband’s arms while curled up on his lap. Alec’s eyes are closed in the shot, and Hilaria’s face is partially obscured by her hair. She captioned the post with a simple red heart emoji.

Just hours earlier, the Santa Fe County District Attorney’s office dropped criminal charges against the “30 Rock” star.

NYPD officers needed to escort the actor. Baldwin had no problem shouting back at them but was quickly met with the ire of the protesters.

“Shut your f—kig mouth, you have no f—king shame,” one man shouted back at Baldwin.

Armorer Hannah Gutierrez-Reed, 27, testified on Thursday that actor Alec Baldwin failed to take firearm training sessions seriously before production began for the upcoming Western movie Rust.

Gutierrez-Reed claimed that Baldwin spent a lot of his time during the training sessions texting on his phone, having his assistant shoot videos of him with a firearm for Instagram, and FaceTiming his wife and children, according to the Hollywood Reporter.

"I walked in, and I said, 'All right, Alec. I’m going to be your armorer. We’re going to go over how to shoot all your weapons, how to load them, how to make them safe, and we’re going to make sure that you really know — that you look like you know what you’re doing,'" she testified to OHSB.

After the session, Gutierrez-Reed testified that she had requested more training time with Baldwin because "his role is so gun-heavy, and I wanted to make sure he was familiar with his weapon."
