Family Of Beaten Senior Fears Soft Sentencing For Teen Suspect Sunday September 10, 2006 Those that knew Bob Tracey say separate or together, the two words that best described the man were "fun" and "loving." The 68-year-old's good-natured personality makes the brutal beating that cost him his life even more inexplicable. Tracey was badly assaulted in broad daylight while on his afternoon walk down a busy street. The attack took place in early 2006 and weeks later, Tracey died of his injuries in hospital. "It's changed all of our lives forever," said Mary Tracey, Bob's wife. "He's just so badly, sadly missed." The attack took place at Bay Mills Blvd. near Sheppard Ave., and though months have passed since, the family's grief has slackened very little. To make matters worse, the suspect arrested in the case was only 17-years-old at the time, meaning it's very unlikely a stiff sentence is forthcoming, even though he was out on bail for a previous assault at the time. "I thought it was horrible that these judges are letting people out and then they are committing serious crimes," said Tracey's niece, Linda. The youth, whose name can't be released, was initially charged with second degree murder, a charge that was later reduced to aggravated assault when it couldn't' be proven the injuries which killed him were sustained in the beating. It's a turn of events that's left the Tracey family saddened and frustrated. "At points you think that the accused has more rights than the public," said Francina Creaney, Tracey's daughter-in-law. "Who's accountable for him while he's out on bail, and our judicial system that's what it allows and it's just unfair." The teen will face sentencing on October 2nd, and the Tracey family expects to be in attendance.
