The Holocaust denier Ursula Haverbeck has to go to prison. After her final conviction for incitement to one year in prison, the Berlin public prosecutor's office asked the 94-year-old to go to prison in North Rhine-Westphalia immediately, as a spokesman for the authorities said on Wednesday.

The "Neue Westfälische" had previously reported. Haverbeck, who lives in Vlotho (Herford district), had tried to be spared prison by applying for incapacity. According to the prosecutor's office, a prison doctor had confirmed her ability to be held prisoner.

Haverbeck is now to serve her sentence in an open prison in Bielefeld-Senne. "There is no fixed time or deadline for this, and we have not yet received a corresponding admission notification from the JVA," said the spokesman for the public prosecutor's office. Originally, the authorities had invited the notorious Holocaust denier in mid-October to begin prison. Haverbeck failed last April with her appeal against two convictions for sedition from 2017 and 2020 before the Berlin Regional Court.

The judge explained that the widow denied the Holocaust. There is no sign of remorse or a rethinking. A total sentence of one year in prison is appropriate to the crime and to blame. For years, criminal courts have repeatedly had to deal with the notorious inciter. In 2004 she was convicted for the first time and received a fine. Most recently, sentences were issued without parole.

Haverbeck repeatedly claimed that the Auschwitz concentration camp was not an extermination camp and that mass murder did not take place there. According to historians' estimates, the Nazis murdered at least 1.1 million people in the Auschwitz-Birkenau concentration camp alone.

Ursula Haverbeck – the 94-year old German scholar and publisher who was facing 12 months in prison for the ‘crime’ of raising questions about the ‘Holocaust’ – will not now be jailed, following a decision just announced in Berlin.

Even after the rejection of a final legal appeal last October, Ursula’s tireless lawyer Wolfram Nahrath had persisted with arguments that it was unacceptable for a 94-year-old lady to be incarcerated – and the authorities seem finally to have accepted this.

We shall have fuller details of the Berlin decision soon.

What is already clear is that international protests played a part in convincing the German authorities that jailing Ursula Haverbeck was a propaganda disaster for them, and that their reputation would suffer even further if the sentence were enforced.

Thanks are therefore due to her lawyer Herr Nahrath, but also to the international campaign that drew attention to the original sentence and to the tyranny of Germany’s jailing of dissident historians.

The next step should be the repeal of the volksverhetzung law itself, which is an outrage against traditional European standards of free historical debate and rational argument.

German “justice” still attempting to jail 95-year-old Ursula Haverbeck

The German publisher and educator Ursula Haverbeck, now aged 95, faces renewed efforts to jail her for daring to speak and write “forbidden” opinions about her own country’s history.

According to a report published in a German newspaper this evening, Ursula was ordered to attend court last month, but this has now been rescheduled.

This is a separate case from the one in which Ursula has already been sentenced to 12 months imprisonment. That sentence was imposed in Berlin in April 2022, but has not yet been served, partly because of certain technical issues, but also because of a delay in finding the correct prison hospital in which a 95-year-old could be imprisoned.

The Hamburg case dates back to 2015, when the district court imposed a ten-month prison sentence. For procedural reasons (partly related to the pandemic period) the Hamburg appeal has not yet been heard, and court dates have now been set for 7th, 12th and 26th June this year.
